Private Hire Car (Operator) Licence

Private Hire Car (Operator) Licences are issued by Falkirk Council in terms of the Civic Government (Scotland) Act 1982 and would permit the licence holder to operate a Private Hire Car within the Falkirk Council area or to and from a location outwith the Council area provided that the journey concerned commences or terminates within the Council's area.

All persons driving a licensed vehicle must have a Private Hire Car Driver or Taxi Driver Licence issued by Falkirk Council.

Falkirk Council has agreed that with regard to all new Private Hire Car (Operator) licences granted after 13 August  2002, any vehicle which has the capacity to carry 5 or more passengers must be fully wheelchair accessible.  In this connection, "wheelchair accessible" means that the wheelchair user must be able to enter and leave the vehicle whilst occupying the wheelchair, and that an appropriate means is provided by which the wheelchair can be secured for the purpose of promoting the safety of the wheelchair at all times whilst the vehicle is in motion.

The vehicle must:

  • be (a) wheelchair accessible (subject to the above) or
    (b) a saloon car
  • have a minimum engine size of 1600cc
  • be no older than six years from the date of first registration of the vehicle or from the year of manufacture where this can be proven
  • have a Taxi Inspection Certificate issued from Falkirk Council's  MOT testing station at Dalgrain Industrial Estate, McCafferty Way, Grangemouth, FK3 8EB (telephone number 01324 590 400)
  • have a current Private Hire Insurance Certificate issued in the name of the applicant.

It is strongly suggested that you contact the licensing section to ensure that the vehicle chosen would be considered suitable to be placed on this type of licence.

Application fees for a Private Hire Car Licence (Operator) are:

  • New application               £235.00
  • Renewal application          £120.00

Generally fees are non-refundable either in full or in part.

Falkirk Council will grant both a new, or a renewal application for a maximum of 1 year.

Application Timescale

In terms of the Civic Government (Scotland) Act 1982, the Council has a period of six months to make a final decision on applications. No decision can be made on an application until a period of 21 days has elapsed.

In practice most applications take approximately three to six weeks to process. Applications where the applicant has revealed spent or unspent convictions or where an objection has been lodged may take longer and may require to be submitted to the Civic Licensing Committee for determination. If necessary, the Council can make an application to the Sheriff to extend the six months if required.

Where an application is being made by a person for a second or subsequent licence, such applications will automatically be submitted to the Civic Licensing Committee for determination.

Convictions/Traffic Offences

Falkirk Council requires the disclosure of all convictions, conditional offers whether traffic offences or otherwise on the application form (spent or otherwise).  A police record check is undertaken for all applicants.  Failure to submit all information will result in your application form being returned to you.

Applications should be lodged with the Licensing Section at the address below, together with:

  • Application form.
  • Application fee (which can be paid in cash, by cheque (cheques should be made payable to "Falkirk Council"), debit/credit card or postal order).
  • A copy of the Vehicle Registration Document or "Bill of Sale" in the applicants name
  • A copy of a Certificate of Motor Insurance confirming he vehicle is covered for "Private Hire" purposes in the applicant's name.
  • Applicants will also require to exhibit a current passport or other photographic ID.
  • Non UK Citizens will require to produce evidence from the appropriate Government Agency/Police Authority from their country of origin and/or other countries where they have resided that they have no convictions or listing all previous convictions.

Refusal of licence

In terms of Paragraph 6 of Schedule 1 to the Civic Government (Scotland) Act 1982, should your application be refused, Falkirk Council are not permitted to accept a further application for such a licence for a period of 1 year from the date of the refusal unless you can demonstrate that there has been a material change in circumstances.
