There are a number of issues and areas of which the street cleansing service within Estates Management do not have responsibility for litter, listed below.
Private Land
If a piece of private land is littered, it is the landowner who has the responsibility for clearing the litter.

Refuse Collection
The street cleansing section of Estates Management has no responsibility for any matters concerning refuse collection e.g. emptying of wheeled bins, special uplifts

Educational Establishments
Under the Environmental Protection Act 1990 schools, colleges and community education centres have a responsibility to keep their own grounds free of litter and refuse.
Any complaints regarding the cleanliness inside these areas should be made directly to the school concerned. For more details see the school information| pages.
Other Duty Bodies
“Duty Bodies” have similar statutory obligations as the Council for litter control, and it is important to be aware of the Bodies and the areas for which they are responsible.
The Scottish Government is the Duty Body in respect of motorways which they contract to a number of companies The motorways within the Falkirk Council area, the M9 and the M876, are maintained by Bear Scotland.
Network Rail is the Duty Body in respect of most railway land.
British Waterways are responsible for litter control along the canal network, and this responsibility extends to towpaths and canal embankments adjacent to the canals.
