The transitional period of the new Licensing (Scotland) Act 2005 comes into effect on Friday 1 February 2008 and ends on 1 September 2009.
During the transition period, all current licences issued under The Licensing (Scotland) Act 1976 will be automatically extended to run until 1 September 2009, and no applications for renewal of these will be required.
After 1 September the Licensing (Scotland) Act 1976 will cease to have effect and these licences will terminate. Similarly, all current Regular Extensions of Permitted Hours, Children's Certificates and Registrations of Members Clubs will also automatically be extended until 1 September 2009.
Applications for new licences can still be made to the Board under the Licensing (Scotland) Act 1976 should this be required. Such applicants are strongly advised to seek the advice of a solicitor on the need for further applications under the new legislation.
Applications for Temporary and Permanent Transfers, Substitution of s.11 nominees, new Regular Extensions and Children's Certificates may also still be made.
