Under Part IIA of the Environmental Protection Act 1990, Falkirk Council is required to maintain a public register of “contaminated land” as defined by the legislation and ensure that it is publicly accessible.
The register is held at Abbotsford House, David’s Loan, Falkirk where it can be viewed. There is no charge for accessing the Contaminated Land register (PDF, 9KB)|.
There are currently no sites in the Falkirk Council area on the register.
Falkirk Council is currently undertaking prioritisation and inspection works, and sites may be added to the register at a later date. The register will be updated within 2 weeks of a site being designated as contaminated land.
Additionally, owners of potentially contaminated sites should note that once a site has been added to the register, there is currently no mechanism in Scotland to remove the site, even if the site is remediated at a later date.
Wherever possible, Falkirk Council will endeavor to work with site owners to try to minimise the number of sites added to the register. It should be noted that encountering contamination on a site may not necessarily result in the site being put on the register, as there is a clear definition of what constitutes contaminated land.
