Building warrants

Do I need to have both a planning application and a building warrant?

Some projects will require both. For more information and advice, please contact the Development Management and Building Standards Unit.

Do I need a building warrant if Falkirk Council have given planning permission?

This varies depending on the project. Please check with our Development Management & Building Standards Unit.

Community Asset Transfer

Will planning permission for any proposed change of use be required before an asset transfer can take place?

Where planning permission is required for a change of use, as defined by the Town and Country Planning (Use Classes) (Scotland) Order 1997, then it will be a condition of the transfer that planning permission is granted before the sale or lease of the asset is completed and asset transferred to the CTB.

Change of use is often not clear-cut and we advise you to contact the Duty Planning Officer at early stage to clarify if planning permission is required. A Duty Planning Officer is available on 01324 504950.

How do I apply for planning permission?

Please talk to us about what you would like to do before you make your application. This can help avoid problems later when you submit your plans.

Do I need planning permission?

You can carry out many types of minor development without getting planning permission first. But it is sometimes hard to decide if planning permission is needed without looking at what you plan to do in more detail.

How can I look at current and historic planning applications or comment on a current planning application?

With our ePlanning system, you can view plans and other documents for current and historic planning applications.

You can search by application number, street or date. You can find applications in your area on a map, view plans, documents and decisions, and make comments on current applications. Please use the “advanced” search tab.

How are planning controls enforced?

We monitor developments to make sure planning controls are being followed. The public also have a role in alerting us to any problems they become aware of.

How do I get approval from the Council in order to discharge a condition attached to a planning application?

How do I make an amendment to an approved planning application?

The formal process for making an amendment to an approved planning application is through the submission of a non-material variation.

We have a legal duty to make sure that we cope well with any emergency or disruption.

Our aim is to raise awareness of hazards and threats and protect local people and the environment from them as best we can.

Planning decision notices

How can I find out about planning application decisions?

If you are the applicant or agent, a formal Notice will be sent to you once your application has been determined. If you have made comment on an application, either in support of or in opposition to a proposal, we will notify you of the decision and how to view the conditions attached or reasons why the application has been refused.

Using our online Planning Application search facility, you will be able to view the actual decision notice on applications determined since August 2008. In the future, we hope to make all historic decisions available through this facility.

How can I get copies of past planning decisions?

Decision notices for applications determined since autumn 2008 are available to download through our Planning Application search facility. This will be a redacted copy, with the Authority signature blacked out. An original document can only be obtained by contacting us, either by letter or email (Development Management, Development Services, Falkirk Council, Abbotsford House, Davids Loan, Falkirk, FK2 7YZ or dc@falkirk.gov.uk).

Older documents will have to be sourced from our archive and may take longer to obtain. For this reason, if you need copies, it is essential that you make requests well in advance of any personal deadlines you might have to meet. A cost of £30 currently applies.

What can I do if I am unhappy about the decision on my planning application?

If your application was a national or major development, or a local development that was decided by the Planning Committee, you have the right to appeal to Scottish Ministers.

You have three months from the date of the decision notice to appeal to Scottish Ministers. Appeals in respect of listed buildings and advertisements are also made to the Scottish Ministers.

If your application was a local development, and the decision was a determined by an officer of the Council, you may request a review by the Planning Review Committee. The Review Committee is made up of Councillors from throughout the Council area.

You have three months from the date of the decision notice to request a review.
