Why do we collect this information?

The information is being collected for the following purposes:

  1. To maintain accurate records, including your name and contact details, to register you on the Self-Build Register.
  2. To understand and monitor the demand for self-build housing in the Falkirk Council area.
  3. To help inform the preparation of plans and policies for housing in the Falkirk Council area.

In terms of 1, Falkirk Council, as the local planning authority, has a statutory duty under Section 16E of the Town and Country Planning (Scotland) Act 1997, as amended, to prepare and maintain a list of persons who have registered interest with the Council on acquiring land in the Falkirk Council area for self-build housing. The information you provide to us will be used to create the list, which will be published in the form of the Self-Build Register on the Council's website.

In terms of 1,2 and 3, we may need to process your information to carry out other public duties under the Town and Country Planning (Scotland) Act 1997 as amended.

What information do we collect?

We collect your name, contact details, including your postal address and email address, and your current housing circumstances.

Where do we collect information from?

You. We get your information when you complete and submit the electronic form to join the Self-Build Register or when you email us.

Who might we share your information with?

Council services

The Council has a duty to protect public funds. We may check your information within the Council for verification purposes and for the prevention of fraud. We may share your information with other organisations where we are required to do so for the purposes of the prevention or detection of crime.

We may also share your information with other Council Services to understand and monitor the demand for self-build housing in the Falkirk Council area and to help inform the preparation of plans and policies for housing in the Falkirk Council area.

The public

The Self-Build Register will be publicly available on the Council's website and will include your name, and your preferred search area, plot size and house type for a self-build home. No other personal information (such as your email address and postal address) will be published in the Self-Build Register.

Will we send your information outwith the UK?

Your information will normally be stored and processed in premises in the Council area or on servers based in the UK.

How long do we keep hold of your information?

We will hold your information for no more than 5 years after the date it was added to the Self-Build Register, after which time you will be removed from the register. However, you can ask to be removed from the register at any time by emailing us:

Do I have to provide my personal data to you?

We may need your information to carry out our duties under the Town and Country Planning (Scotland) Act 1997 as amended.

There may be consequences if you do not provide your information. Depending on the situation, the consequences may include:

  • Insufficient information to include you on the Self-Build Register
  • No contact information for Falkirk Council to contact or assist you with your interest in self-build housing
